What is Implied Consent?
Implied Consent is the law that “implies” that all holders of a Tennessee driver license “consent” to a blood alcohol content (BAC) test. The penalty to refusing to cooperate and offer a BAC sample is the loss of your license for a year. However, you can still obtain a restricted license to get to school or work. If the driver does not incriminate himself/herself, many DUI arrests cannot be successfully prosecuted. It is in your legal interest to politely, but firmly, refuse to give a breath or blood sample, and to not offer any evidence against yourself.
