What is a DUI “Per Se”?
A DUI “per se” is a DUI based on a certain blood alcohol content level. As of 2009 every state, including Tennessee, has determined that any blood alcohol content (BAC) level of 0.08% or more is a de facto or “per se” DUI. In addition, anyone charged with a DUI whose BAC is 0.20% or more can face a minimum of ten days in jail, even as a first offender!
